Every week we help a family settled in Canada, the UK, Australia or the Gulf buy back home. The good news: NRIs can buy residential and commercial property in India freely. The trick is doing it cleanly from a distance.

What you can and can't buy

As an NRI or OCI, you can purchase residential and commercial property in India. You cannot buy agricultural land, plantation property or farmhouses (these can only come to you by inheritance). Payments must route through your NRE/NRO/FCNR accounts via normal banking channels — never cash.

The documents you'll need

  • Valid passport and OCI/PIO card (as applicable), plus overseas address proof.
  • PAN card — mandatory for the transaction and taxes.
  • A registered Power of Attorney if you can't be present for signing/registry.
  • NRE/NRO account details for the money trail.

Power of Attorney — do it right

A correctly drafted, properly attested POA (from the Indian consulate abroad or notarised and adjudicated in India) lets a trusted person complete the registry for you. A vague or wrongly executed POA is the single most common reason NRI deals stall. Get it drafted specifically for the transaction.
